ONLINE STORE REGULATIONS

 

I. Definitions

The terms used in the Regulations mean:

  1. Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, which places an Order within the Store;
  2. Store Manager – the person running the Store, i.e. Oskar Walczewski, conducting business activity under the name WARHOG.PL Oskar Walczewski.
  3. Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
  4. Regulations – these Regulations for the provision of services electronically as part of the Afterglow Miniatures Games online store;
  5. Online Store (Store) – online service available at www.afterglowthegame.com through which the Customer may, in particular, place Orders;
  6. Goods – products presented in the Online Store;
  7. Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between the Store Operator and the Customer, concluded using the Store’s online service;
  8. Act on specific terms of consumer sales – Act of 27 July 2002 on specific terms of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended);
  9. Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
  10. Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

 

II. General provisions

  1. These Regulations define the rules of using the online store available at www.shop.ignisartminiatures.com.
  2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
  3. The online store available at www.afterglowthegame.com is run by Oskar Walczewski, conducting business activity under the name WARHOG.PL Oskar Walczewski, registered in the Central Registration and Information on Business (CEIDG), run by the minister responsible for economic affairs.

  4. Inquiries and complaints can be directed to warhogstore@gmail.com or by phone: +48 505 678 559 (charged according to the price list of the relevant operator).
  5. These Regulations specify in particular:
    1. rules for registering and using an account in the online store;
    2. terms and conditions for submitting Orders electronically within the online store;
    3. principles of concluding Sales Agreements using the services provided within the Online Store.
  6. Using the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
    1. an internet browser with a market penetration of at least 5% in Poland according to the "gemiusRanking" website (http://ranking.pl/).
    2. In order to use the online store, the Customer must, at their own expense, obtain access to a computer station or terminal device with Internet access.
  7. In accordance with applicable law, the Store Operator reserves the right to limit the provision of services via the Online Store to persons who are over 18 years of age. In such a case, potential Customers will be notified thereof.
  8. Customers can access these Regulations at any time via the link on the home page of the website www.shop.ignisartminiatures.com. The recording, securing, making available and confirming to the Customer the essential provisions of the Agreement for the sale of Goods shall be effected by sending to the Customer an e-mail address provided and by attaching a printout of the confirmation, the Order specification and the VAT invoice to the shipment containing the Goods.
  9. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and operational parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.

 

III. Rules for using the Online Store

  1. Registration is not required to use the store.
  2. Registration is performed by completing and accepting the registration form available on one of the Store’s pages.
  3. The condition for registration is to agree to the content of the Regulations and to provide personal data marked as mandatory.
  4. The Store Operator may deprive the Customer of the right to use the Online Store, and may also limit their access to some or all of the resources of the Online Store, with immediate effect, in the event of a breach of the Regulations by the Customer, and in particular when the Customer:
    1. provided false, inaccurate or outdated data, misleading data or data violating the rights of third parties, during registration in the online store,
    2. has violated the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,
    3. engages in other behaviors that are deemed by the Store Operator to be inconsistent with applicable legal provisions or general principles of using the Internet or detrimental to the good name of the Store Operator.
  5. A person who has been deprived of the right to use the online store may not re-register without the prior consent of the Store Operator.
  6. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent via the Internet.
  7. The customer is obliged in particular to:
    1. not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
    2. using the Online Store in a way that does not disrupt its functioning, in particular through the use of specific software or devices,
    3. not to take actions such as: sending or placing unsolicited commercial information (spam) within the Online Store,
    4. using the Online Store in a way that is not burdensome for other customers and the Store Operator,
    5. use any content posted on the Online Store only for your own personal use,
    6. use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

 

IV. Procedure for concluding a Sales Agreement

  1. In order to conclude a Sales Agreement via the Online Store, go to the website www.afterglowthegame.com, select the Goods, taking subsequent technical steps based on the messages displayed to the Customer and the information available on the website.
  2. The Customer selects the Goods to be ordered by adding them to the shopping cart.
  3. During the Order placement process – until the “Order” button is pressed – the Customer has the option to modify the entered data and the selection of the Goods. For this purpose, the Customer should follow the messages displayed to them and the information available on the website.
  4. After the Customer using the Online Store has provided all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information regarding:
    1. subject of the order,
    2. the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
    3. selected payment method,
    4. selected delivery method,
    5. expected delivery time,
  5. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and click the "Order" button.
  6. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Store Operator, in accordance with the Regulations.
  7. After placing the Order, the Customer receives an e-mail containing the final confirmation of all essential elements of the Order.
  8. The Agreement is deemed to have been concluded upon receipt by the Customer of the e-mail message referred to above.
  9. The sales agreement is concluded in Polish, with content consistent with the Regulations.

 

V. Delivery

  1. Delivery of Goods, within the territory of the Republic of Poland and abroad, takes place to the address indicated by the Customer when placing the Order.
  2. Delivery of ordered Goods is done by courier, post, parcel locker or by personal collection at the Store's headquarters. Detailed delivery costs are presented at shop.ignisartminiatures.com. Additionally, delivery costs will be indicated at the time of placing the Order.
  3. The delivery time is from 2 to 7 working days from the day the Customer sends the Order. In the case of Goods that are not in the Store's warehouse, the delivery time may be longer depending on the Goods. Availability is specified on the page of the given product.

 

VI. Prices and payment methods

  1. The prices of the Goods are given in Polish zloty, Euro and in USD and include all components, including VAT, packaging costs and all other components. The price does not include shipping costs.
  2. When ordering home delivery, the Customer can choose the payment method:

VII. Right to withdraw from the contract

  1. The Customer who is a consumer within the meaning of Article 22[1] of the Civil Code has the right – under the provisions of law – to withdraw from the contract concluded at a distance without giving any reason. In order to exercise the right to withdraw from the contract, the Customer must inform the Store Owner in writing to WARHOG.PL Oskar Walczewski, ul. Sportowa 1/11, 26-600 Radom, tel. +48 505 678 559 or e-mail: warhogstore@gmail.com, of their decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by traditional mail or e-mail).
  2. The time limit for withdrawal from the contract expires after 14 days from the date on which the Customer came into possession of the Goods or on which a third party other than the carrier and indicated by the Customer came into possession of the Goods.
  3. In the event of withdrawal from a distance contract, the contract is considered not to have been concluded. What the parties have provided is returned in an unchanged state, unless the change was necessary within the limits of ordinary management. The return should take place immediately, no later than within 14 days. Purchased goods should be returned to the following address:

  4. Goods returned by the Customer should be packed in an appropriate manner to ensure that the shipment is not damaged during transport.
  5. The costs of returning the Goods are borne by the consumer, unless the withdrawal was caused by even a temporary inability of the Store Operator to provide the goods with the properties ordered by the consumer.
  6. In the event of withdrawal from the contract, the Customer will be refunded all payments received, including the costs of delivering the Goods (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method offered by us), immediately and in any case no later than 14 days from the day on which the Store Operator received the returned Goods. The Customer is responsible for any reduction in the value of the Goods resulting from using it in a manner other than necessary to establish the nature, characteristics and functioning of the Goods.
  7. The refund will be made using the same means of payment that the Customer used in the initial transaction, unless the Customer expressly agrees to another solution; in any case, the Customer will not incur any fees in connection with this refund. The Store may withhold reimbursement until it receives the Goods or until the Customer provides proof of sending them back, depending on which event occurs first.

 

VIII. Complaints about Goods

  1. The Store Operator, as the seller, is liable to the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code for non-compliance with the Sales Agreement of the Goods purchased by that consumer, to the extent specified in the Act on specific conditions of consumer sales.
  2. Complaints arising from a breach of the Customer's rights guaranteed by law or under these Regulations should be sent to warhogstore@gmail.com. The Store Operator undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

 

IX.Complaints regarding the provision of services by electronic means

  1. The Store Operator takes steps to ensure the proper operation of the Store, to the extent that results from the current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
  2. The Customer is obliged to immediately notify the Store Operator of any irregularities or interruptions in the functioning of the Online Store service.
  3. The Customer may report irregularities related to the operation of the Store in writing to the following address: ul. Sportowa 1/11, 26-600 Radom, by e-mail to warhogstore@gmail.com, by phone at +48 505 678 559 or using the contact form.
  4. In the complaint, the Customer should provide his/her name and surname, correspondence address, type and date of the irregularity related to the operation of the Store.

 

X. Final provisions

  1. Any disputes arising between the Store Operator and the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code shall be referred to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
  2. Any disputes arising between the Store Operator and the Customer who is not a consumer within the meaning of Art. 22[1] of the Civil Code shall be submitted to the court having jurisdiction over the seat of the Store Operator.
  3. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of services by electronic means and other relevant provisions of Polish law shall apply.
